Eligibility Requirements

The applicant must confirm all three conditions:

  1. The imported dual-use items will not be used for any purpose other than the declared end-use without prior Chinese government approval
  2. The imported dual-use items will not be transferred to any third party other than the declared end-user without prior Chinese government approval
  3. The imported dual-use items will not be used for the storage, processing, production, or handling of weapons of mass destruction or their delivery systems

How to Apply

Step 1 — Submit online File through the MOFCOM Unified Business Platform for Dual-Use Item Import/Export Controls: https://ecomp.mofcom.gov.cn

Upload all electronic documents through the platform. Submit the original End-User and End-Use Certificate plus the printed Application Form to your provincial commerce authority. All other documents are electronic only — no additional hard copies required.

Step 2 — Provincial review Your provincial commerce authority forwards the application and required physical documents to MOFCOM.

Step 3 — MOFCOM review MOFCOM reviews the application, either independently or jointly with relevant departments. In certain cases, approval from the State Council is required.

Step 4 — Collect your license Once approved, the authorization data is transferred to your provincial commerce authority. Collect the Dual-Use Item Export License from your provincial office. Present the license at customs clearance (paperless customs procedures apply per MOFCOM/GAC Announcement No. 66, 2020).

FAQ

How do I apply for a dual-use export license? The entire process is paperless. Apply online at ecomp.mofcom.gov.cn, then submit the End-User Certificate (original, signed) to your provincial commerce authority. MOFCOM reviews and responds within the statutory timeframe. Collect your electronic license from the provincial system.

Does the End-User Certificate need to be an original? Yes. It must carry the end-user’s authorized signatory handwritten signature and official seal, plus a Chinese translation confirmed accurate by the exporter’s stamp.

Can the end-use description differ between the form and attachments? No. All descriptions of the item’s end-use must be completely identical across all documents — in both Chinese and English.

Can the consignee field list an intermediary? Yes, if there is an intermediary between the importer and end-user, the intermediary may be listed as consignee. A supplementary explanation or relevant trade contracts must be provided.

Can I modify the license after issuance? Changes to key elements (item type, destination country, end-user, end-use) require a new application — the original license must be returned and exports suspended in the interim. Changes to non-key elements require a formal amendment application to MOFCOM; exports must be suspended pending approval.

How do I determine if my product is a controlled dual-use item? Refer to the PRC Dual-Use Item Export Control List and relevant MOFCOM announcements. If uncertain, submit a business inquiry through the platform with the item’s technical specifications, intended use, and reason for uncertainty. HS commodity codes are for reference only and are not the determining criterion.

Do items moving between bonded zones require a license? No. Movement of dual-use items between special customs supervision zones and bonded areas, or from outside into such zones, does not require an export license. Customs supervision applies instead.

Can one contract be split across multiple license applications? Typically one contract corresponds to one application. If splitting is necessary, a written explanation is required and the total quantity across all applications cannot exceed the contract total. One application cannot reference multiple contract numbers.

How do I check my application status? Log in to the enterprise portal of the MOFCOM Dual-Use Item System, locate your application, and click “Progress Inquiry”.
